SIA "BRAIN GAMES" (Latvia), registration No. 40003690406, address: Brīvības iela 103 - 4, Riga, Latvia, LV-1001, hereinafter referred to as BRAIN GAMES, provides the content available on the website www.brain-games.lv, hereinafter referred to as the Website, and provides services in accordance with the terms and conditions, delivery terms, return policy, other terms and conditions, and operating policy outlined below and available on the Website (all collectively referred to as the Terms and Conditions) and are an integral part thereof.

If a consumer, using the Internet, purchases products offered on the BRAIN GAMES Website, hereinafter referred to as "Goods", then such mutual agreement is considered a Distance Contract and is subject to legal norms governing Distance Contracts, including, but not limited to, Directive 97/7/EC of the European Parliament and of the Council on the protection of consumers in respect of distance contracts, the Law of the Republic of Latvia "Consumer Rights Protection Law", and the Regulations of the Cabinet of Ministers of the Republic of Latvia "Regulations on Distance Contracts".

PRICING POLICY

On the website www.brain-games.lv all prices are indicated in Euro (EUR) currency, however, any locally operating online store may indicate prices in the currency of the respective country. We strive to ensure that prices are always indicated accurately, but we cannot guarantee that the prices indicated at the time of ordering will be the correct, currently valid product prices. Upon receipt of your order, if the indicated price differs from the price indicated on the website at that time, we will contact you and offer you the option to cancel the order. If we are unable to contact you quickly, your order will automatically be considered cancelled and you will receive a refund of all payments made within the scope of that order.

All prices are subject to VAT or other sales taxes, if applicable. Depending on the delivery address, your order may be subject to an additional shipping fee, which will be clearly indicated before confirming payment and included in the total order price.

RETURN POLICY

Each issue related to the return of a customer's placed and delivered order is considered separately according to a simplified procedure.

Shipping costs are not refunded.

Opened games and used goods are not accepted back.

DISPUTE RESOLUTION PROCEDURE

If a dispute arises in connection with this Website, all rights and obligations provided for in these Terms and Conditions, as well as all actions within them, shall be governed by the laws of the Republic of Latvia to the extent as if these Terms and Conditions were a contract fully concluded and fully performed in Latvia.

The contracting parties hereby affirm that they will endeavor to resolve all disputes relating in any way to your visit to the Website, or arising in connection with the execution, interpretation, or termination of this Distance Contract, through mutual negotiations.

If the parties are unable to resolve the dispute peacefully through negotiations, they shall submit all disputes, disagreements, or claims for consideration to one of the courts of the Republic of Latvia, unless you have in any way infringed or attempted to infringe our intellectual property rights or the intellectual property rights of our subsidiaries, partners, or licensors, in which case we may seek an injunction or other appropriate legal remedy from any court, and you agree to submit to the exclusive jurisdiction of such court and the consideration of the case in that court.

The parties have agreed on the place and procedure for dispute resolution, observing the provisions of Regulation 953/2008 of the European Parliament on the law applicable to contractual obligations (Rome I).

If a dispute arises between BRAIN GAMES and the consumer regarding whether the terms included in the concluded contract are unfair, either contracting party has the right to appeal to the court specified in this point, but the consumer also has the right to appeal to the Consumer Rights Protection Centre, address: K. Valdemāra iela 157, Riga, Latvia, LV-1013.

If a dispute arises between BRAIN GAMES and the consumer regarding personal data protection issues, either contracting party has the right to appeal to the court specified in this point, but the consumer also has the right to appeal to the Data State Inspectorate, address: Blaumaņa iela 11/13-15, Riga, Latvia, LV-1011.

GENERAL PROVISIONS

You agree that these Terms and Conditions constitute the entire current agreement between you and BRAIN GAMES regarding your use of this Website and its content.

BRAIN GAMES has the right to amend and clarify these terms at any time by publishing the respective changes on the Website and indicating the date of the last changes. Any changes made to these Terms and Conditions shall become effective immediately upon their publication. FORCE MAJEURE

SIA "BRAIN GAMES" is not responsible for delays in fulfilling or non-fulfillment of obligations, or other types of non-performance, arising due to circumstances and obstacles beyond our reasonable control, which include, but are not limited to, strikes, government orders, acts of war or national emergencies, threats of terrorism or acts of terrorism, environmental or climatic anomalies, non-performance by third parties, internet connection disruptions, as well as computer equipment and software failures. In the event of such force majeure circumstances, we will try to eliminate the resulting delays as soon as possible.
